Icon Education Society v. State of Madhya Pradesh 2023 SCC Online SC 289

Supreme Court two judges bench held that a minority educational institution cannot claim complete immunity from fee regulation by claiming protection under Article 30(1) of the Constitution of India. The Court relied upon the T.M.A Pai and P.A. Inamdar case that established the law for the administration and interference of the minorities educational institutions.

Anoop Baranwal v. Union of India, 2023 SCC Online SC 216

Supreme Court Constitution Bench decision for this month held that unless a law is made by Parliament, Election Commissioners are to be appointed by the President of India on the advice of a Committee consisting of the Prime Minister, and leader of Opposition in the Lok Sabha (or leader of the largest opposition party), and Chief Justice of India.

Union of India v. M/s. Union Carbide Corporation (2023)

Supreme Court Constitution Bench decision for this month dismissed the curative petition seeking to reopen the settlement with the Union Carbide Corporation to claim additional compensation for victims of the Bhopal Gas Tragedy 1984. The Court held that the settlement can be set aside only on the ground of fraud, but no ground of fraud has been pleaded by Govt.

Premchand v. State of Maharashtra, 2023 SCC Online SC 218

Supreme Court two judges bench, in this case, has summarised the settled principles with respect to Section 313 (Power to examine the accused) of the Code of Criminal Procedure, 1973.

Orissa Administrative Tribunal Bar Association v. Union of India, 2023 SCC Online SC 309

Supreme Court two judges bench has held that Article 323A does not preclude the Union Government from abolishing State Administrative Tribunals. Supreme Court upheld the notification issued by the Central Government to abolish the Odisha Administrative Tribunal.

Ashwini Kumar Upadhyay v. Union of India (2023)

Supreme Court 2 judges bench has dismissed the plea to rename places named after Muslim rulers. The Court held that India, that is ‘Bharat’ in terms of the Preamble, is a secular country. The governance of Bharat must conform to the rule of law, secularism, and constitutionalism.
