Supreme Court issued a split decision regarding the ban on wearing the hijab in educational institutions in Karnataka. It is ultimately a matter of choice and Article 19(1)(a) and 25(1) of the Constitution.

  • Daughter is capable of inheriting her father’s self-acquired estate, irrespective of such devolution taking place before the enactment of the Hindu Succession Act, 1956 Act.
  • The judgment emphasises on the importance of Section 14 & Section 15 of the Act.

Janhit Abhiyan v Union of India, 2022

  • In a 3-2 majority, the Supreme Court upheld the 103rd Constitutional Amendment providing EWS reservation. With this, the Court extended the net of reservation benefits to include solely economic backwardness.
  • The Supreme Court held that 103rd Constitution Amendment cannot be said to breach the basic structure of the Constitution by permitting the State to make special provisions in relation to admission to private unaided educational institutions.
  • 50% reservation established by Indra Sawhney is not absolute – the limit could be breached in extraordinary situations.

Re: T. N. Godavarman Thirumulpad v. Union of India, 2022

The apex court directed that each protected forest (national park/wildlife sanctuary) must have an eco-sensitive zone (ESZ) of minimum one kilometre measured from the demarcated boundary of such protected forest.
